Helping you understand and prepare for the future

Estate administration occurs following the death of an individual through filing of a petition for administration of a decedent's estate. Such filing occurs with the Orphans' Court and/or Probate Court, depending on the State of the decedent's residence at the time of death. If the decedent left a Last Will and Testament, it is submitted as part of the process in order for the decedent's wishes as outlined in the Last Will and Testament be honored. If the decedent did not leave a Last Will and Testament, then the law of the State in which the decedent was resident of will govern the distribution of the asset left by the decedent. Conducting such an administration may be complicated.

Trust may require administration as well. If you are appointed a trustee in a trust, you will need to follow any and all authority given to you in the trust document. You also need to understand and determine your rights and obligations under the terms of the trust and Maryland Law. You can contact Karpouzian Law Firm for your questions and to determine how to effectively handle the assets of the trust as a trustee for the benefit of named beneficiaries.

There may also be tax issues. Maryland estate taxes and/or federal taxes may need to be addressed in an estate and trust matter. There may also be post-mortem planning opportunities whether involving disclaimers or determining which assets to use to fund bequests.

If you are named a personal representative in a Will, or a Trustee in a trust, or a beneficiary, and you have questions regarding your fiduciary duties, obligations, or rights as a beneficiary, call us at the Law Office of Gilda O. Karpouzian to get the answers you need
